Privacy Policy
General
This Agreement is entered into on the date of signature below between The Chapel, LLC a Nevada Limited Liability Company hereafter referred to as (“Chapel of the Flowers”), (“Chapel”) or (“we”) and the undersigned affiliate (“you”) or (“agent”). This agreement may be terminated by either party at any time upon written notice. However, all prior commitment and duties shall be honored. This Agreement shall be governed by the laws of the State of Nevada. Any legal action or other proceeding stemming from this agreement shall be brought in the federal or state courts having venue in Clark County, Nevada.

Booking Policy
Bookings must be made using the agent portal or in writing via email by submitting the Client’s (1) name, (2) address, (3) phone number and email address, (4) desired ceremony date and time along with two alternative times, (5) desired ceremony location, (6) desired package, and (7) Payment. Booking will not be considered confirmed until you receive a confirmation email from Chapel of the Flowers.

Payment and Commission
Commission is paid on Venue Fees, Packages, and Products purchased prior to the ceremony. Some exclusions apply. Please note: Commission is not paid on Gratuities, Taxes, and Processing Fees.


Initial deposit is due upon submission of booking. This payment is refundable for up to 72 hours after payment is made. After 72 hours it becomes non-refundable but is extendable and transferable for up to one (1) year of date of payment.


Remainder of payment is due 35 days prior to date of ceremony. If final payment is not made by you or the client 30 days prior to the ceremony, it is possible that the ceremony and accompanying products and services will be cancelled.


A 4% credit card transaction fee will be applied to ALL credit/debit cards used.


All invoices shall be paid within 5 calendar days. A late fee of $100 shall be due for any collection efforts and an additional 15% shall be assessed for every month past due.


In order to receive commission, a W-9 form for domestic affiliates and a W-8 form for international affiliates must be on file with us. Please provide this document along with the signed contract.

Agent Pre-Pay Affiliates - Unless otherwise indicated to you in writing, you are considered a valued pre-pay affiliate. A nonrefundable deposit is due upon booking. The balance of the package is due 35 days prior to date of ceremony, at which time, the commission owed to you will be deducted from the balance owed for the correlating package. Payment shall be processed with the credit card on file. Unless already paid by agent, Client is responsible for any add ons 30 days prior to ceremony. If added by client less than 30 days prior to ceremony, payment must be made immediately.
Agent Invoice Affiliates - No deposit is required. You will receive a monthly invoice for the ceremonies that took place the month before and for the packages that booked but did not cancel timely the month before. All commission owed by Chapel of the Flowers will be deducted from amounts owed by agent on said invoice.
Client Pre-Pay Option - Should you elect to have payment made by client directly to the Chapel, you must supply payment information on behalf of client. Commission owed to agent shall be made via ACA within 30 days after the ceremony takes place and shall include package commission and any add on commissions.
Web to Web Affiliates and Direct Booking Affiliates shall be paid in the following manner. Tier 1 -10% (1-20 ceremonies), Tier 2 15% (21-49 ceremonies), Tier 3-20% (50+ ceremonies). Tier status is based on previous 12-month period. Commission is not earned on add ons; only on initial ceremony booked. Timing of ACH payments can be discussed with accounting.
Cancellations
If you or the client cancel the ceremony more than thirty (30) days before the originally confirmed date and time, we will gladly refund all payments except for the initial booking payment of the required package deposit and venue fee. However, all amounts paid become non-refundable within (30) days of the initially confirmed date and time. Once within the 30-day window of the original booking date, only credit will be given for date changes and are subject to rescheduling fees and additional policies. All payments made within 30 days of the ceremony and after the ceremony has been completed are nonrefundable.

Changes of Date and Time

A rescheduling fee is waived for the first change of date, time or chapel if you or the client call more than 14 days prior to the confirmed ceremony date and time. All other changes may incur a $100 rescheduling fee.


Rescheduling will not be allowed if you or the client contact us within seven (7) days of the confirmed ceremony date and time and want to reschedule for a date more than seven (7) days from the original date and time. If the client needs to reschedule under these circumstances, they must purchase an entirely new ceremony package.


Although we do offer vow renewals and commitment ceremonies, Couples wishing to be legally married are required to obtain a Marriage License from the State of Nevada. We cannot perform a wedding without such license. If we are forced to reschedule due to the couple not having such license, the above cancellation and change policies will apply.

Minister Fees and Gratuities
As you likely know, gratuities are customary for any service provider, especially in Las Vegas. Many couples wish to recognize their limousine drivers and photographers with a gratuity and their Ministers with a fee but are unsure of the typical amounts. Below you will see what is suggested based off Las Vegas industry standards.


Limo Driver(s): $25-$50 per driver. Photographer: $30-$90 depending on length of shoot. Minister’s Fee: $70 for Chapel of the Flowers and $85 for Tropicana LV Weddings.


CHAPEL OF THE FLOWERS DOES HAVE POLICIES CONCERNING THE FOLLOWING: LIMOUSINE TRANSPORTATION, TIMELY ARRIVAL, FLORAL ORDERS AND OUTSIDE FLORISTS OR FLOWERS, GUEST PHOTOS AND FILMING, PHOTOGRAPHY, ALCOHOL AND/OR FOOD AND OTHERS. IF YOUR CLIENT HAS QUESTIONS CONCERNING ANY OF THE FOREGOING, IT IS YOUR RESPONSIBILITY TO DIRECT THEM TO US OR TO ANSWER WITHIN ACCORDANCE OF OUR POLICIES WHICH ARE AVAILABLE ON OUR WEBSITE.

Confidentiality
This contract and pricing remains confidential between you and Chapel of the Flowers and shall not be disclosed to third parties. Unauthorized disclosure will automatically terminate this agreement.

Escape Travel Club Terms:

 

Not a Property Management Company:

Escape Travel Club operates as a platform for property owners and managers to showcase and Market their vacation homes to potential members of their properties. All properties listed on the website are independently and individually owned and managed by their respective owners and managers. Escape Travel Club does not assume any responsibility the accuracy of the property, availability, or any other aspect of the property listings. As such, all inquiries, bookings, and payments are to be made directly with the property owner manager. Escape Travel Club is not the property manager nor the owner of any property being showcased on the website, and therefore, is not liable for any damages or losses resulting from the use of the website or the properties listed on it.

Affliateion Payments and Booking Platforms:

Escape Travel Club LLC company operates as a customer service concierge specializes in providing support to travel itineraries within the booking platform terms and vendors selected. It is important to note that Escape Travel CLub do not represent any vendor, but rather provide recommendations to it's affiliates links for marketing and commission payments directly from vendors. As part of our services Escape Travel Club may take a percentage base pay for sharing affiliate website links to customers and help facilitate the process of booking an experience or share a direct link to Airbnb listings. Additionally, it is crucial to adhere to the terms of each booking platform and property management/owner's guidelines within local jurisdiction. It is worth mentioning that Escape Travel Club is not representing a property owner or property management, and any property listing questions or local requirements should be directed to the listing owner, who will be able to respond directly and take payments directly.​​​​

Property Owners Disclosures:

At our company, we hold all property owners a high standard of compliance. As such, we require all owners to elect a property manager or selfage their property. It is the responsibility of the property owner or manager to stay informed of local requirements and adhere to all guidelines. Additionally, accurate property listing addresses, property disclosures, and home inspections are the responsibility of the property owner or manager. We take these requirements seriously to ensure the safety and satisfaction of all parties involved.

Release of Liability:

By participating in any activities or using any services provided by Escape Travel Club and its affiliates, you agree to release them from any liability any injury, loss, or damage that may occur during your stay or travel. This includes but is not limited to accidents, illnesses, theft, or any other unforeseen circumstances. You acknowledge that you are responsible for your own safety and well-being, and that you read and understood all terms and conditions provided by Escape Travel Club and its affiliates.

Guest Privacy and Disclosures

At Escape Travel Club, we take guest privacy very seriously and do not sell any guest or owner information. We understand the importance of keeping personal information confidential and strive to maintain a safe and secure environment for all our guests.

Method of Payment and Deposits:

 

We would like to kindly remind you that all guests must be of legal age, which is 18 years old or above, when an itinerary with us. As part of our booking confirmation process, we may require ID verification to ensure the safety and security of all our guests. We like to inform you that additional fees and deposits apply for guests who are under the age of 25 years old. We would like emphasize that we do not accept gift cards, coupons, or checks as a method of payment. We require a valid credit card for all booking details. Debit Cards may require a $1,000 deposit additional to all booking platforms. We appreciate your trust in our services and look forward to assisting you with your travel needs.

Escape Travel Club/ETC Additional Terms:

 

This Agreement constitutes a legal agreement between you (‘you’ or ‘User’) and Escape Travel Club LLC. d/b/a Escape Travel Club (‘ETC’ or ‘us’). This Agreement governs your use of our services and platform that facilitates communications between Users offered through our website located at https://EscapeTravelClub.co, as it may be modified, relocated and/or redirected from time to time (the ‘Site’), and the mobile applications offered by us (the ‘Apps’). Our services, platform, Site and Apps are collectively referred to as the ‘Escape Travel Club Platform’.

By accessing, using or registering with the ETC Platform or any portions thereof, you hereby expressly acknowledge and agree to be bound by the terms and conditions of this Agreement, and any future amendments and additions to this Agreement as we may publish from time to time. Please read this Agreement carefully. If you do not agree to accept and be bound by this Agreement, you must immediately stop using the ETC Platform. ETC's acceptance is expressly conditioned upon your assent to this Agreement in its entirety. If this Agreement is considered to be an offer by us, acceptance is expressly limited to this Agreement.

By using the ETC Platform, you represent and warrant that: (i) you are at least 18 years old, are at least of the legally required age in the jurisdiction in which you reside, and are otherwise capable of entering into binding contracts; and (ii) you have the right, authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement, and that you will so abide. Where you enter into this Agreement on behalf of a company or other organization, you represent and warrant that you have authority to act on behalf of that entity and to bind that entity to this Agreement.

To the extent permitted and except where prohibited by applicable law, these Terms of Use include:

Your agreement that either party may compel binding arbitration for most types of disputes, and your agreement to submit to an informal dispute resolution process for at least 30 days prior to the initiation of any claim..

Your agreement that no claims can be adjudicated on a class basis.

Your agreement that the ETC Platform is provided ‘as is’ and without warranty.

Your agreement that the ETC Platform is solely a communications platform providing a method for Professional Services to be booked, that all Professional Services are performed by third parties, and that Escape Travel Club has no liability for any Professional Services or any acts or omissions of third parties.

Your acknowledgement of and agreement to pay ETC's Platform Fee that will be applied to each appointment of a Professional Service requested through the ETC Platform.

Your acknowledgement of and agreement to ETC's cancelling policies and cancelation fees.

Your agreement to release ETC from liability based on claims relating to Services and otherwise and your agreement to the limitation of time within which a claim can be brought.

Your agreement that you will not work with any service providers that ETC introduces to you outside of the ETC Platform.

Your agreement to indemnify ETC from claims due to your use, misuse or inability to use the ETC Platform, the Merchandise and/or Professional Services, your violation of this Agreement, applicable laws or third party rights, and/or content or information submitted from your account to the ETC Platform.

Your consent to any modifications or amendments to this Agreement.

Your consent to the collection, use, sharing and transfer of your data as outlined in the Privacy Policy as updated from time to time.

The parties hereby acknowledge that they have required this Agreement and all related documents to be in the English language.

Users on the site acknowledge that they have read and understand these Terms of Use and Privacy Policy, and agree that their use of the ETC Platform is an acknowledgement of their agreement to be bound by all of the Terms and Conditions of this Agreement.
